ADU Rules

  • Accessory Dwelling Unit (ADU): a self-contained unit located within, attached to, or detached from a single-family dwelling unit located on the same parcel of land.

  • An Accessory Dwelling Unit shall be permitted provided all the following conditions are met:

    • An accessory dwelling unit must be a minimum of 190 square feet and may not exceed 900 square feet.

    • Only one (1) Accessory Dwelling Unit is permitted per lot with a single-family dwelling.

    • An ADU shall be exempt from any density requirements or calculations related to the area in which the ADU is constructed.

    • Any new construction for an ADU must meet all applicable setbacks, lot coverage, and building height requirements.

    • If an ADU is created within an accessory structure existing as of July 1, 2024, the setbacks of such structure shall apply.

    • Either the ADU or the primary dwelling unit must be occupied by the owner of the property.

    • An ADU is not subject to any additional parking requirements beyond the parking requirements of the single-family dwelling unit on the lot where the ADU is located.

    • The ADU must share the existing access drive of the primary residential dwelling unit.

    • The existing access drive must be improved to meet current town standards.

    • An ADU is permitted on a non-conforming lot, as defined in Article 2 of this Ordinance, provided it does not increase the degree of nonconformity of any structure.

    • The owner of an ADU must provide written verification to the municipality that the accessory dwelling unit is connected to adequate water and wastewater services before the municipality may certify the ADU for occupancy.
